TERMS OF USE

Effective date: 6 November 2026 (planned launch date; confirm before publication) | Last updated: 11 October 2026

1. Who we are and what these Terms cover

These Terms of Use (“Terms”) govern access to and use of the HABIBTI website, mobile applications, features and related services (together, the “Platform”). The Platform is operated by HABIBTI DATING PRIVATE LIMITED, a company incorporated under the laws of India, with its registered office at C-160 Vardhman Sarovar, Opp Heera Path Petrolpump, Mansarovar, Jaipur, Rajasthan, 302020 (“HABIBTI”, “we”, “us” or “our”).

These Terms apply to Dating, profiles, discovery and matching, chat and other communications, Community posts and stories, events, creators, verification, safety and reporting tools, paid memberships, Promote or visibility products, rewards, and features introduced later. Some features may have additional terms shown before you use or purchase them. If a feature-specific term conflicts with these Terms, the feature-specific term controls only for that feature, to the extent legally permitted.

2. Acceptance and electronic contracting

By creating an account, selecting an acceptance control, purchasing a feature, or using the Platform after being shown these Terms, you agree to these Terms and the linked policies. Where the law requires express consent, we will ask for it separately and will not treat general use as a substitute. Save or download a copy for your records. If you do not agree, do not create an account or use the Platform.

3. Eligibility: adults only

The Platform is strictly for individuals aged 18 or older. You must provide truthful date-of-birth information and must not use another person’s identity or credentials. We may use proportionate age-assurance measures, request evidence where lawful and necessary, restrict access while checking a credible concern, and remove accounts reasonably believed to belong to minors. We will handle suspected minor accounts under our child-safety and data-deletion procedures and applicable law.

You must have legal capacity to enter a binding contract and must not be prohibited by law from using the Platform. HABIBTI is not designed for children and does not knowingly invite them to join. If you believe a minor has accessed the Platform, report it immediately through in-app reporting tools or [SAFETY / CHILD-SAFETY CONTACT TO BE PROVIDED BEFORE PUBLICATION].

4. Nature of the service; no promise of a relationship

HABIBTI provides digital tools intended to help adults discover, communicate with and build connections with other adults. We do not guarantee that profiles are genuine, that any user will respond, that a match will occur, that a relationship will form, or that a connection will be safe, compatible or successful. Matching, recommendations, prompts, rankings and other automated outputs are aids, not professional advice or guarantees.

Unless a feature is expressly described otherwise, HABIBTI is not a matchmaking agency, marriage broker, background-check provider, emergency service, therapist, medical provider or legal adviser. Any educational or relationship-building content is general information and not a substitute for qualified professional advice.

5. Account creation, accuracy and security

  • Provide accurate, current information and update material changes. Do not misrepresent your age, identity, relationship status, intentions, location, occupation, qualifications or verification status.
  • Keep login credentials and one-time passwords confidential. You are responsible for activity on your account to the extent caused by your failure to protect access, subject to applicable law.
  • Notify us promptly at [SECURITY CONTACT TO BE PROVIDED BEFORE PUBLICATION] if you suspect account takeover, impersonation or unauthorised access.
  • One person may not operate accounts to evade a restriction, manipulate visibility, impersonate another person or manufacture engagement. We may apply reasonable account limits and anti-fraud controls.
  • We may request verification or temporarily limit features when needed for safety, fraud prevention, legal compliance or platform integrity.

6. Profiles, matching and visibility

You control the profile fields you choose to provide, subject to fields required for account operation, age assurance, safety or legal compliance. Profile visibility depends on your settings and the feature used. Other users may view, screenshot, record or redistribute information you choose to share; we cannot guarantee that recipients will keep it confidential. Avoid posting addresses, financial details, identity-document numbers, passwords or other information that could put you at risk.

Location-based features require device permissions where applicable. We will describe whether a feature uses precise, approximate or inferred location and will provide available controls. Do not assume that hiding your exact location prevents all inference from distance, profile information, photos or user conduct.

7. Messages, calls and off-platform contact

You are responsible for deciding whether to communicate, share contact details, meet, or continue a conversation outside HABIBTI. Do not send unwanted sexual content, threats, repeated contact after being asked to stop, extortion, intimate images without valid consent, or links intended to steal information. We may use reports, user controls and proportionate automated or human review to detect and address abuse, fraud, spam, threats and policy violations, subject to the Privacy Policy and applicable law.

Messages may be retained or reviewed when necessary to deliver the service, respond to a report, enforce rules, investigate fraud, protect users, comply with law or resolve a dispute. We do not promise end-to-end encryption unless the specific feature expressly states that it uses it.

8. Community and user content

You may be able to post text, photographs, videos, stories, comments, events or other material (“User Content”). You retain ownership of your User Content, subject to the limited licence below and rights others may have in it. You are responsible for ensuring that you have the necessary rights, permissions and consent to upload it.

You grant HABIBTI a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, adapt for technical formatting, display and distribute your User Content solely as reasonably necessary to operate, secure, moderate, improve and promote the Platform in accordance with your settings and the Privacy Policy. This licence ends when the content is deleted from active service, except for copies retained in backups, legal records, evidence, dispute handling or where other lawful grounds apply. We will not use private profile photos or intimate content in external advertising without a separate appropriate permission.

You must not upload content that is unlawful, deceptive, defamatory, infringing, exploitative, threatening, hateful, harassing, sexually exploitative, non-consensual, or that violates another person’s privacy or rights. We may remove or restrict User Content under the Community Guidelines and applicable law. Content moderation does not mean we endorse user statements or guarantee that every violation will be detected.

9. Prohibited conduct

  • Any sexual exploitation, grooming, sexualisation of minors, child sexual abuse material, or attempts to contact minors for sexual purposes.
  • Impersonation, catfishing, fake profiles, deceptive verification claims, identity theft or use of another person’s photos without permission.
  • Harassment, stalking, threats, hate, doxxing, blackmail, sextortion, non-consensual intimate imagery, or sharing private conversations/images to intimidate or humiliate.
  • Romance scams, investment/crypto scams, requests for money, gift cards, UPI transfers, loans, financial credentials, OTPs or account access through deception.
  • Spam, commercial solicitation, escort/prostitution solicitation, trafficking, illegal services, pyramid schemes, or unauthorised fundraising.
  • Scraping, bulk collection, reverse engineering, automated account creation, fake engagement, manipulation of matching or Promote systems, or circumvention of security controls.
  • Malware, phishing, unauthorised access, service disruption, infringement of intellectual property, or unlawful disclosure of personal data.
  • Using the Platform to discriminate unlawfully, organise violence, evade lawful restrictions, or facilitate any offence.

10. Verification and trust signals

A verification badge, selfie/liveness check, phone/email confirmation or other trust signal indicates only that a specified check was completed under the process described at that time. It is not a guarantee of identity in every respect, honesty, criminal-record status, relationship status, intentions or safety. We do not claim that every user undergoes a criminal background check unless we explicitly say so for a particular service and explain its scope.

Where verification uses third-party tools, we will identify the relevant categories of providers and describe the purpose and data handling in the Privacy Policy. If biometric or face-related processing is contemplated, do not launch it until counsel has confirmed the lawful basis, necessity, notices, retention, vendor terms, security and app-store requirements.

11. Safety, reporting, blocking and enforcement

Use in-app report/block tools or contact [SAFETY / CHILD-SAFETY CONTACT TO BE PROVIDED BEFORE PUBLICATION] to report suspected abuse, fraud, impersonation, non-consensual imagery, threats or minor-safety concerns. We may warn, remove content, reduce visibility, suspend features, suspend or terminate accounts, preserve relevant records, refer matters to competent authorities where required or appropriate, and take other proportionate measures. We may act without prior notice when reasonably necessary to prevent harm, preserve evidence, protect users or comply with law.

We will provide a channel to appeal eligible moderation decisions at the in-app appeal option or [APPEALS EMAIL TO BE PROVIDED BEFORE PUBLICATION]. Appeals may be limited where disclosure would expose another person, compromise safety, reveal detection methods or conflict with law. Nothing in this section limits statutory remedies or legally required grievance processes.

12. Paid features, membership and Promote

Paid features may include membership tiers, profile visibility tools such as Promote, consumables or other digital benefits. Before payment, the purchase screen must state the exact price, currency, duration, renewal status, included features, material limits, taxes if applicable, cancellation route and any eligibility restrictions. A feature may increase exposure or provide access to specified functionality, but it does not guarantee likes, matches, replies, dates or relationships.

Subscription and payment rules are set out on any store-specific purchase screen. The purchase screen and these Terms must be consistent. Where an app store processes payment, its billing, cancellation and refund mechanisms may apply. We will not state that all purchases are non-refundable where mandatory law or store rules provide otherwise.

13. Community Rewards and promotions

Any rewards, milestones, events, challenges, Mystery Box, spin-wheel, scratch-card, referral or promotional programme is governed by the official rules displayed for that specific programme. Do not assume a reward exists unless it is shown in the applicable official rules. Rewards may be subject to eligibility, verification, conduct, availability, geographic restrictions, deadlines, taxes and supplier conditions.

HABIBTI must not launch any paid chance-based reward, randomised paid box, lottery-like mechanic, prize draw or cash-equivalent benefit until Indian counsel has assessed gaming, lottery, consumer, advertising, tax, payment and state-law implications. Marketing must not imply guaranteed travel, concert tickets, cash, sponsorship or other high-value prizes unless the company has approved, funded and documented the specific offer.

14. Intellectual property and limited platform licence

The Platform, software, branding, design, text, graphics and other materials owned by HABIBTI or its licensors are protected by applicable intellectual-property laws. Subject to these Terms, we grant you a limited, personal, revocable, non-exclusive, non-transferable licence to use the Platform for its intended lawful purpose. You may not copy, resell, exploit, modify or create derivative works from the Platform except as permitted by law or with our written permission.

If you believe content infringes your rights, contact [IP / COPYRIGHT CONTACT TO BE PROVIDED BEFORE PUBLICATION] with the URL or location, identification of the work/right, your contact details, a good-faith statement and any supporting information. We may remove content and process counter-notices as required by law.

15. Third-party services and links

The Platform may rely on app stores, payment processors, cloud hosts, analytics, verification, customer-support, communications, mapping or other third-party services. Their terms and privacy practices may apply to their services. We are not responsible for independent third-party services, except to the extent applicable law imposes responsibility on us. We will not imply that a third party endorses HABIBTI without authorisation.

16. Availability, changes and beta features

We aim to keep the Platform available and secure but do not promise uninterrupted, error-free or permanently available service. We may patch, maintain, change, suspend or discontinue features for operational, safety, legal or business reasons. Where reasonably practicable, we will provide advance notice of material changes affecting paid access. Experimental or beta features may be incomplete and may change, but mandatory consumer rights remain unaffected.

17. Account suspension, termination and deletion

You may stop using the Platform and request account deletion through the account-deletion option in the app's account settings or [CONTACT DETAILS TO BE PROVIDED BEFORE PUBLICATION]. Deletion of an account does not automatically cancel a subscription purchased through an app store; you must also cancel through the applicable billing channel. We may suspend or terminate an account for a material breach, risk to users, fraud, legal requirement, prolonged inactivity under a disclosed policy, or discontinuation of the service. Where appropriate and safe, we will explain the reason and available appeal route.

After deletion, profile visibility will be disabled and personal data will be erased or de-identified according to the retention schedule in the Privacy Policy, subject to backups, security logs, legal obligations, claims, fraud prevention and other lawful retention grounds. We will not retain personal data indefinitely merely because it may be useful.

18. Disclaimers and allocation of risk

To the maximum extent permitted by law, the Platform is provided on an “as available” basis. We do not warrant user statements, identity, compatibility, safety, uninterrupted access, or specific outcomes. Users are independent individuals; HABIBTI does not control their conduct and cannot eliminate all risks associated with online interaction or offline meetings.

Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited, including rights or remedies under applicable consumer, privacy, information-technology or other mandatory law, or liability for fraud, wilful misconduct, or other matters that cannot legally be disclaimed. Any lawful limitation of liability must be proportionate, clearly disclosed and approved by counsel; do not insert an arbitrary cap that purports to remove non-waivable consumer rights.

19. Indemnity

To the extent permitted by law, you are responsible for losses, claims and reasonable costs directly arising from your unlawful conduct, your infringement of another person’s rights, or your material breach of these Terms. This provision does not require you to indemnify HABIBTI for HABIBTI’s own negligence, misconduct, legal violations or liabilities that cannot lawfully be shifted to you.

20. Governing law and disputes

These Terms are governed by the laws of India. Subject to mandatory consumer rights and the jurisdiction of competent statutory forums, courts at Jaipur, Rajasthan may have jurisdiction. Do not select a forum solely for company convenience if it would unlawfully restrict a consumer’s statutory rights. Nothing in these Terms prevents a user from approaching a competent consumer commission, regulator, law-enforcement agency or other authority where permitted by law.

21. Changes to these Terms

We may update these Terms to reflect product, operational, security or legal changes. We will update the “Last updated” date and, for material changes, provide notice and obtain renewed acceptance where required. We will not rely on a blanket clause to retrospectively remove rights or impose materially new obligations without an appropriate legal basis.

22. Severability, waiver and entire agreement

If a provision is unenforceable, it will be limited only to the extent necessary and the rest will remain effective. Failure to enforce a provision is not a waiver. These Terms, the Privacy Policy and applicable feature-specific terms form the agreement between you and HABIBTI regarding the Platform, subject to mandatory law.
